Terms of Service
These Terms of Service ("Terms") govern your use of ProgramOS, a football program management platform operated by Monson Development ("ProgramOS," "we," "us," or "our") and accessible at programos.org and related applications. By creating an account or using the service, you agree to these Terms. If you are using ProgramOS on behalf of a football program, school, or organization, you represent that you have authority to bind that entity to these Terms.
1. The Service
ProgramOS is a software-as-a-service platform that helps football programs manage rosters, recruiting, athletic evaluation, behavioral assessment, communications, fundraising, and program operations. Features and pricing tiers are described at programos.org and may change from time to time.
2. Eligibility
You must be at least 18 years old to create an account, or be using the platform with the active consent and supervision of a parent or legal guardian. Programs are responsible for collecting parental consent before inviting athletes under 18 to the platform.
3. Accounts and Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@programos.org if you suspect unauthorized access. We may suspend or terminate accounts that show signs of compromise, fraud, or violation of these Terms.
4. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of NCAA, NJCAA, NAIA, or state high school association rules
- Upload or distribute malware, exploit code, or content that infringes intellectual property rights
- Harass, threaten, dox, or impersonate any person through the platform
- Send messages through ProgramOS to recipients who have not opted in or who have opted out
- Scrape, reverse-engineer, or attempt to bypass authentication or rate limits
- Use the platform to send commercial marketing messages unrelated to the operation of your football program
- Resell, sublicense, or share access to the platform with parties outside your program
We may suspend or terminate accounts that violate these rules.
5. SMS Communications (10DLC) — Required Disclosures
ProgramOS sends transactional text messages on behalf of football programs to staff, athletes, and parents / guardians who have opted in. The categories of messages include: recruiting communications, schedule notifications, behavioral assessment invitations, fundraising campaign updates, and account-related notifications.
Message and data rates may apply. Standard messaging rates from your wireless carrier apply to all messages sent and received. ProgramOS does not charge a per-message fee for receiving texts.
Message frequency varies. The number of messages you receive depends on your role (coach, athlete, parent, donor) and the activity of your associated program. Athletes in active recruitment may receive several messages per week; parents may receive only occasional updates.
To opt out, reply STOP at any time. When you reply STOP to any text from ProgramOS or your program, we will immediately stop sending you SMS messages and confirm the opt-out. You will still be able to log in to the platform and receive in-app and email notifications.
For help, reply HELP. Replying HELP at any time will return contact information for support.
Carrier disclaimer. Wireless carriers (AT&T, T-Mobile, Verizon, US Cellular, and others) are not liable for delayed or undelivered messages.
Support contact. For SMS-related questions, including delivery issues or opt-in / opt-out problems, email support@programos.org.
6. Subscription and Payment
Programs that subscribe to ProgramOS pay according to the pricing tier selected at signup. Subscriptions renew automatically until cancelled. You may cancel at any time from your account settings or by emailing support@programos.org. Cancellations take effect at the end of the current billing period; no partial refunds are issued for unused time except where required by law.
Donations made through fundraising campaigns are processed by Stripe and are subject to a platform fee disclosed during checkout. Donations are not refundable except where required by law or under the policies of the receiving program.
We may change pricing with at least 30 days' written notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.
7. Your Content
You retain ownership of the content you upload to ProgramOS (rosters, profiles, film links, evaluations, messages, donations, etc.). By uploading content, you grant ProgramOS a limited, worldwide, royalty-free license to host, store, transmit, and display the content as necessary to operate the service for you and your program.
You are responsible for ensuring that you have the rights to upload the content and that it complies with these Terms and applicable laws.
8. Intellectual Property
ProgramOS, the programos.org website, the software, the design, the CORE-5 mindset assessment, and all related trademarks are the property of Monson Development and are protected by U.S. and international intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the service; they do not transfer any ownership rights.
9. Termination
You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms, if your program ends its subscription, or if continued service would expose ProgramOS, other users, or third parties to material risk. Upon termination, your access ends; data retention and deletion are described in our Privacy Policy.
10. Disclaimers
The service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Our total liability for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the limitations above apply to the maximum extent permitted.
12. Indemnification
You agree to indemnify and hold harmless Monson Development and its officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the service, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property, privacy, or publicity right.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law rules. Any dispute arising out of or related to these Terms or the service will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top and, if the changes are material, notify you by email or through the platform at least 30 days before the changes take effect.
